The case involved serious allegations of undue influence, breach of fiduciary duty, and tortious interference with an expectancy of inheritance, brought against our client by his three siblings.
Attorneys Arthur Vincent, Esq. and Brandan J. Pratt, Esq., successfully defended the youngest son of a deceased father who, after providing over a decade of live-in care, was gifted the family home through a deed executed by the father with independent legal counsel. Despite prior guardianship proceedings initiated by the Plaintiffs—which were dismissed following a unanimous finding of full mental capacity by a court-appointed committee—the Plaintiffs continued to challenge the validity of the gift and estate planning.
At trial, the Plaintiffs alleged that their younger brother had exerted undue influence over their father, orchestrated the legal documents, and diverted assets. The defense demonstrated that the gift was intentional, legally sound, and consistent with the father’s clearly expressed wishes, as documented by independent professionals and reinforced by the father’s subsequent creation of a trust naming all four children as equal beneficiaries—excluding the already-gifted home.
After five days of testimony, the jury returned a unanimous verdict in favor of the Defendant on all claims. The Court has reserved jurisdiction to award attorneys’ fees and costs.
